1. Acceptance of Terms By using SmartScaleEvents.com (“the Site”) you agree to abide by these terms and conditions. If you do not agree, you should not use the Site or services offered.
2. Services SmartScale Events provides a platform for event organisers to create, promote, and sell tickets for events. We act as a facilitator between organisers and attendees. We do not control the quality, safety, legality, or any other aspect of the events.
3. User Accounts To create or book events, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Ticket Purchases and Fees All ticket sales are subject to availability and the terms set by the event organiser. Fees, taxes, and commissions may apply. Refund and cancellation policies are determined by the organiser and may vary per event.
5. Conduct You agree not to use the Site for any unlawful purpose or in a way that could damage or impair the Site. This includes, but is not limited to, posting false information, infringing intellectual property rights, or attempting to gain unauthorised access to our systems.
6. Intellectual Property All content on the Site, including text, graphics, logos, and software, is the property of SmartScale Events or its licensors and is protected by copyright and other laws. You may not reproduce, distribute, or create derivative works without permission.
7. Limitation of Liability SmartScale Events is not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or attendance at events. Our total liability for any claim arising out of or relating to these terms or the services will not exceed the amount of fees we have received from you in the past 12 months.
8. Indemnification You agree to indemnify and hold harmless SmartScale Events, its affiliates, and its partners from any claims, damages, or expenses arising from your use of the Site or services, violation of these terms, or infringement of any rights.
9. Changes to Terms We may modify these terms at any time. If we make material changes, we will notify you by posting an update on the Site. Continued use of the Site after any changes constitutes your acceptance of the new terms.
10. Governing Law These terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes will be resolved in the courts of Harris County, Texas.
